1. Agreement
These Terms of Use (“Terms”) are an agreement between you and Clifford Francisco, doing business as Fordytech Solutions, of Naga City, Camarines Sur, Philippines (“we,” “us”), the developer of the CarMind app (“CarMind,” “the app”). By downloading, installing or using CarMind, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the app.
You must be at least 13, or the minimum age in your country, to use CarMind. If you are under 18, you need a parent’s or guardian’s permission to buy a subscription.
2. Your license to use CarMind
We give you a personal, non-exclusive, non-transferable, revocable license to use CarMind for your own non-commercial purposes on devices that you own or control: on Apple-branded devices as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, and on Android devices as permitted by the Google Play Terms of Service. You may not copy, modify, reverse engineer, resell, rent or sublicense the app, or use it to build a competing product, except where the law expressly allows it.
3. Your account
You can use most of CarMind without an account. If you create one, give a valid email address, keep your password secret and tell us if you think someone else has used your account. You are responsible for activity under your account. You can delete your account at any time in the app (Settings → your account → Delete account).
4. CarMind Pro, subscriptions and purchases
CarMind is free to download, and Free includes 10 CarMind AI questions a day and the Glovebox for your OR/CR and driver’s license. CarMind Pro unlocks extra features, currently CarMind AI questions with no daily limit, unlimited vehicles, every paper in the Glovebox, the car loan tracker, cloud backup and sync, export, your own Home and Reports layout, and no ads. Pro is sold as an auto-renewing subscription, billed monthly, every 3 months or yearly, at the prices shown in the app before you buy.
- Payment is charged to your Apple Account (on iPhone) or your Google Play account (on Android) when you confirm the purchase.
- A subscription renews automatically at the same price and for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
- You can manage or cancel a subscription at any time. On iPhone, go to Settings → your name → Subscriptions. On Android, open the Google Play Store app → your profile picture → Payments & subscriptions → Subscriptions. Deleting the app or your CarMind account does not cancel it.
- Pro may start with a free trial (currently 14 days), as shown in the app before you subscribe. The trial converts to a paid subscription when it ends unless you cancel at least 24 hours before. Any unused part of a trial is forfeited when you buy a subscription.
- Purchases are handled by Apple or Google, and refunds are subject to their policies. For the App Store, request a refund at reportaproblem.apple.com. For Google Play, request one from your Google Play order history; if Google Play can’t help, contact us.
- If we change the price of a subscription, Apple or Google will tell you in advance and, where required, ask for your consent.
- Promo or offer codes, when we give them out, are redeemed through the store’s purchase screen in the app and follow the store’s terms. A code that gives free time converts to a paid subscription at its end unless you cancel.
- If you change devices, use Restore purchases in the app to get Pro back. Pro bought on iPhone and Pro bought on Android are separate purchases, but signing in to your CarMind account brings Pro to your other phone.
We may add, change or remove features over time. If we remove a core Pro feature you have paid for, we’ll give you notice and, where the law requires it, a fair remedy.
5. Your content
Your vehicle records, expenses, photos, documents and messages (“your content”) belong to you. You give us permission to store, process and send your content only as needed to run the features you use, as described in the Privacy Policy. You are responsible for your content and for having the right to add it. For example, only add other people’s documents with their permission.
6. CarMind AI
CarMind AI uses artificial intelligence to give general information about car care, symptoms, costs and quotes, based on the details you enter. It can be wrong, incomplete or out of date. It cannot inspect your vehicle and it is not a substitute for a qualified mechanic, your vehicle’s manufacturer, or your owner’s manual.
- Check important information yourself, especially anything involving brakes, steering, tires, airbags, fuel or electrical systems.
- If your vehicle shows a warning light, smells of fuel or smoke, or drives unsafely, stop driving it when it is safe to do so and have it inspected.
- CarMind AI has a daily question limit (currently 3 on Free and 30 on Pro), and we may limit use that is automated, abusive or excessive.
- Don’t use CarMind AI to create unlawful, harmful or misleading content, or to get around its limits.
7. Reminders, scans and estimates
Reminders, odometer estimates, due dates, fuel economy figures, cost reports and scan results are calculated from the information you give and may not be exact. Notifications depend on your device settings and may be delayed or not delivered. CarMind helps you keep track, but you remain responsible for maintaining your vehicle, following the manufacturer’s schedule, and keeping your documents valid. Check the details read from a scan before you save them.
8. Use CarMind safely
Do not use CarMind while driving. Only use it when you are parked safely, or let a passenger use it. Always obey traffic laws.
9. Acceptable use
Don’t misuse CarMind. For example, don’t break the law with it, interfere with or overload our servers, try to access other people’s data, upload malware, or scrape or resell the service.
10. Third-party services
CarMind works with services run by others, such as maps, AI, web search and advertising services, and the app store you downloaded it from. Their own terms apply, and we are not responsible for their content or availability. Nearby places, fuel prices and web results may be inaccurate or out of date. You must also follow any third-party terms that apply to you, such as your mobile carrier’s terms.
11. Our intellectual property
CarMind, its design, code, text and logo belong to us or our licensors and are protected by law. Car manufacturer names and logos shown in the app belong to their owners and are used only to identify your vehicle. Using them doesn’t mean those manufacturers endorse CarMind. If you send us feedback or ideas, we may use them without owing you anything.
12. Disclaimers
To the fullest extent the law allows, CarMind is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that the app will be uninterrupted or error-free, that it will never lose data, or that its information will be accurate. Keep your own copies of important records.
13. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, vehicle damage, repair costs or missed maintenance arising from your use of CarMind. Our total liability for any claim about CarMind is limited to the greater of the amount you paid us for CarMind in the 12 months before the claim, or USD 50. Some places don’t allow these limits, so they may not fully apply to you. Nothing in these Terms limits rights you have as a consumer that cannot be waived by law.
14. Ending these Terms
You can stop using CarMind at any time by deleting the app and, if you have one, your account. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we stop offering the app. If that happens, your license ends, but sections 5, 11 to 13, and 15 to 17 continue to apply.
15. Apple-specific terms
If you downloaded CarMind from the Apple App Store, you and we also agree that:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for CarMind and its content.
- Your license is limited to using CarMind on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Apps can also be used by other accounts linked to you through Family Sharing or volume purchasing.
- We are solely responsible for providing maintenance and support for CarMind. Apple has no obligation to provide any maintenance or support for the app.
- If CarMind fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any. To the maximum extent the law allows, Apple has no other warranty obligation for CarMind. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our responsibility, to the extent these Terms don’t disclaim them.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to CarMind or your use of it. This includes (i) product liability claims, (ii) any claim that the app fails to meet a legal or regulatory requirement, and (iii) claims under consumer protection, privacy or similar laws.
- If a third party claims that CarMind or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Questions, complaints or claims about CarMind should be sent to us using the contact details at the end of these Terms.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
16. Google Play-specific terms
If you downloaded CarMind from Google Play, you and we also agree that:
- These Terms are between you and us only, not Google. We, not Google, are solely responsible for CarMind, its content, and its maintenance and support.
- Your download and purchases are also subject to the Google Play Terms of Service and Google Play’s payments terms. Where those terms conflict with these Terms about how Google Play works, Google’s terms apply to that part.
- Questions, complaints or claims about CarMind should be sent to us using the contact details at the end of these Terms.
17. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Any dispute that can’t be resolved informally will be heard by the courts of Naga City, Camarines Sur, unless the law where you live gives you the right to bring it in your local courts.
18. Changes to these Terms
We may update these Terms as CarMind changes. We’ll revise the effective date above and, for significant changes, tell you in the app or on this page before they take effect. If you keep using CarMind after a change takes effect, you accept the updated Terms. If any part of these Terms can’t be enforced, the rest still applies.
